These Terms and Conditions ("Terms") govern your use of the website forkeeps.uk (the "Site") and any purchase you make from us. Please read them carefully before ordering. By using the Site or placing an order, you agree to be bound by these Terms.

1. Who we are

References to "we", "us" or "our" are to Addington Ltd (trading as Positive Retail), a company registered in England and Wales under company number 14330868, VAT registration number 448047973, whose registered office is at 76 Canterbury Innovation Centre, University Road, Canterbury, Kent, England, CT2 7FG. We trade online as "For Keeps" at forkeeps.uk.

2. Using our Site

By using the Site, you confirm that you are at least 18 years old, or are using the Site under the supervision of a parent or guardian, and that you are legally capable of entering into a binding contract.

We may update, suspend or withdraw the Site, or any content on it, at any time without notice. We do not guarantee that the Site, or any content on it, will always be available or uninterrupted.

3. Products

We make every effort to display the colours, materials and details of our products as accurately as possible. However, we cannot guarantee that your device will display colours accurately, and slight variations may occur between the product shown online and the product you receive.

Product images are for illustrative purposes only. Packaging may vary from that shown.

All products are subject to availability. We will inform you as soon as possible if a product you have ordered is unavailable and, where payment has already been taken, arrange a refund.

4. Prices and payment

All prices on the Site are shown in pounds sterling (GBP) and are inclusive of UK VAT (VAT registration number 448047973) unless stated otherwise. Prices are correct at the time they are published, but we reserve the right to change prices at any time without notice; this will not affect orders we have already confirmed.

Payment is taken via the payment methods offered at checkout. By providing payment details, you confirm that you are authorised to use that payment method.

5. Orders and acceptance

When you place an order, you will receive an order confirmation email. This confirms we have received your order but does not mean it has been accepted. A contract between you and For Keeps is formed only when we send you a separate email confirming that your order has been dispatched.

We reserve the right to refuse or cancel any order, for example where a product is listed at an incorrect price or description due to an error, where we suspect fraudulent activity, or where a product is out of stock. If we cancel an order after payment has been taken, you will receive a full refund.

6. Delivery

We currently deliver within the United Kingdom only. Estimated delivery times are provided at checkout and on our Shipping Information page, but are not guaranteed and may be affected by circumstances outside our control.

Risk in the products passes to you on delivery. Ownership of the products passes to you once we have received payment in full.

7. Your right to cancel

As a UK consumer, you have a legal right to cancel your order within 14 days of receiving your goods, without giving any reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

To cancel, please contact us at help@forkeeps.uk before the 14-day period expires, stating your order number. You must then return the goods to us within 14 days of telling us you wish to cancel. Full details of how to return an item are set out on our Returns page.

This right to cancel does not apply to goods made to your specification or personalised, or to goods which are not suitable for return for health or hygiene reasons if unsealed after delivery.

8. Faulty or damaged items

If a product you receive is faulty, damaged, or not as described, please contact us at help@forkeeps.uk with your order number and photographs of the issue. Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, including your rights to a repair, replacement, price reduction or refund where goods are faulty.

9. Intellectual property

All content on the Site, including text, graphics, logos, images and the For Keeps name and branding, is owned by or licensed to us and is protected by copyright, trade mark and other intellectual property laws. You may not reproduce, copy, distribute or otherwise use any content from the Site without our prior written consent.

10. Acceptable use

You agree not to use the Site: in any way that breaches any applicable law or regulation; to transmit any unsolicited advertising or promotional material; to knowingly transmit any data or upload any material containing viruses or other malicious code; or to attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to it.

11. Our liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Subject to the above, our liability to you in connection with any order will be limited to the price of the products ordered, and we will not be liable for any indirect or consequential loss, or for any loss of profits, business, or business opportunity.

Nothing in these Terms affects your statutory rights as a consumer.

12. Events outside our control

We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events outside our reasonable control, including but not limited to strikes, adverse weather, or failures of third-party carriers.

13. Privacy

Your personal information is collected and used in accordance with our Privacy Policy, which explains what information we collect, how we use it, and your rights in relation to it.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law or in how we operate. The version published on the Site at the time you place an order will apply to that order. We recommend you check this page periodically.

15. Governing law and complaints

These Terms are governed by the laws of England and Wales. If you are a consumer, you may bring proceedings in the courts of England and Wales, or in the courts of the part of the UK in which you live.

If you are not satisfied with how we have handled a complaint, you may also be able to refer it to an alternative dispute resolution provider.
